Abstract

The purpose of this article is to analyze Hans Kelsen’s position regarding the notion of justice and its relation to values. The first part examines the concept of justice from the criticism that Kelsen makes to the way from the philosophy has established the values as the founding principles of justice and law, and the second one, it is discussed the new concept of law that Kelsen proposed from a purifying perspective in which the “scientific reason” has a priority position over values and moral constraints.
